Terms of Service
These Terms of Use (hereinafter "TOS") govern the registration, use and access to the services of Dailymed made available by the company AGILOUS, a limited liability company, with capital of 1 000 euros , having its registered office at 3 rue du Lendemain, Cergy (95800), registered with the Pontoise Trade and Companies Register, under number 803 906 189, represented herein by its manager, acting in that capacity and duly authorized.
Each user is automatically bound to these conditions. Dailymed reserves the right to modify the TOS at any time. These changes will not be retroactive.
In any case, the Terms of Dailymed Services are governed by the latest version of these Terms available at any time on the application Dailymed heading CGU.
Any modification of the GTU is notified by email sent to the email address associated with the user's account on the day of publication. By continuing to access and / or using Dailymed Services after the effective date of these changes, the user agrees to be bound by the updated Terms of Use.
Definitions:
For the purpose of understanding and interpreting these terms and conditions of use, the following terms are defined as follows:

CPS: Health Professional Card
Dailymed: The name given to the application and / or the company administering the application.
Member Physician: A user authorized to create or have already created a Profile on the Site according to the terms specified in these terms and conditions of use.
Profile: Site Interface allowing each Member to access the Dailymed Services of the application.
Network: Community space composed solely of Members, allowing communication, networking and mutual aid between physicians.
RPPS: Shared directory of health professionals.
Dailymed Services: all the services accessible on the Dailymed application.
User: User of the Dailymed application.
The above definitions apply to both these terms of use.
Dailymed presentation:
General presentation
Dailymed is a secure application, reserved exclusively for Member Physicians. Its main purpose is to enable exchanges and mutual aid between physicians on their clinical cases.
Dailymed also provides tools and services that are useful to Physicians in the practice of their profession.
The features of Dailymed

Dailymed offers the following features:
  • Clinical case sharing Dailymed Doctors can create clinical cases based on patient information such as symptoms, age, gender, history, case images, and description. Cases that have a time constraint and require special attention may be displayed: urgent cases.
  • Modification of images to share relating to clinical cases When Dailymed Member Physicians create clinical cases, they have the ability to add up to six HD images associated with a clinical case. They also have the ability to change the image by blurring, trimming and reframing to preserve the anonymity of patients. They can also annotate images Post clinical cases anonymously. Member Physicians on Dailymed can anonymously publish clinical cases. This can help preserve the anonymity of the patient and the doctor.

  • Functionality of mention Dailymed users can be mentioned in the publications. The person mentioned will receive a notification.
  • Hashtag and Trends Hashtags are generated using this "#" symbol and writing a keyword with it without using a space. This feature is used to create trends on Dailymed, allowing users to easily track trends that interest them. Dailymed users can use this feature in symptoms, history, description when creating a clinical case. They can also use this feature on reviews they publish on clinical cases.
  • Votes Dailymed users may vote on published notices to show their approval on certain published medical opinions.
  • Specialty page The specialties page allows the Member Physicians to consult the list of all the medical specialties existing in France. This list in card form shows the total number of physicians enrolled in each specialty and the number of physicians who are not yet registered on Dailymed.
  • Physicians' page The page of the doctors allows the Doctors members to consult the list of all the doctors in France.
Free application
The features of the application require that the user connects to the Internet through his mobile terminal. The use of the application is free except for the costs necessary for its use, whether relating to hardware, software or access to the Internet, these being the sole responsibility of the user .
How to use Dailymed:
Required configuration
The User can use Dailymed through the website www.dailymed.fr
In order to use the Dailymed application via a mobile phone or tablet, the User must have:
  • A mobile terminal compatible with the application, such as a smartphone or tablet, with an operating system either Android or iOS.
  • Appropriate Internet access and / or a telephone subscription allowing access to the Internet, download of the application, recovery of a password, and possible access to Dailymed.
Creation of the Profile and acceptance of the Terms
The creation of a Profile on Dailymed is reserved exclusively for physicians regularly practicing in France and is subject to verification by Dailymed by a highly secure mechanism.
The Member Physician undertakes to provide, during the creation of his Profile, accurate information and to produce, within a reasonable time, a proof of his identity upon request from Dailymed.
The Member Physician undertakes not to use a pseudonym or an e-mail address that could infringe on the rights of third parties (in particular the use of the surname, pseudonym, the mark of others, or works protected by law). copyright and / or a neighboring right) for whatever reason and on whatever basis.
The mandatory or optional nature of the communication of the requested data is mentioned on the form for each field of collection. In the case where the communication of the data is obligatory, the absence of their communication will result in the absence of treatment of the request for registration of the Member Physician.
Access to the service and its use by the Member Physician are subject to his full acceptance of these terms of use, which is materialized, when creating his Profile, by the fact, for the Physician member check the box "I accept the general conditions of use".
Who can use Dailymed:
The use of Dailymed is reserved exclusively for doctors who have a RPPS number, regularly practicing in France:
  • Physicians practicing individually, in clinic and in hospital.
  • Interns in Medicine.

Dailymed Services are in no way intended for people who are not doctors and who do not regularly practice in France. Users of the Dailymed application acknowledge that they fulfill the above conditions, accepting only one Dailymed account created with their true identity.
Users agree to make personal use of their account and acknowledge that they have not been prohibited by Dailymed from using its Services. The creation of an account with incorrect information constitutes a violation of these conditions.
To join the Dailymed community as physician members, physicians must scan their CPS or CPF into the Dailymed application. Dailymed uses optical character recognition technology from CPS or CPF cards to verify that users who create a profile on Dailymed are doctors and have a professional health card.
The users of the application declare that they fulfill the above conditions.
Rule of use:
Member Physicians hold their Dailymed account. They declare to be responsible for any use of their account and exchanges with other Doctors members.
Users of Dailymed Services undertake to:
  • Select a secure password and protect the security and confidentiality of their password;
  • Comply with the law, the rules of their ethics, as well as these general conditions of use;
  • Not to create a false identity on Dailymed, to forge an identity, to create a Member profile for anyone other than themselves (a real person), or to use or attempt to use the account of another;
  • Do not develop, support, or use software, devices, scripts, robots, or any other means or processes (including indexing robots, browser plug-ins and add-ins, or any other technology) to perform web scraping of the Services or otherwise copy profiles and other data of the Services;
  • Not to copy, use, disclose or distribute any information obtained from the Services, whether directly or through third parties (such as search engines), without the consent of Dailymed;
  • Not to divulge information that they do not have permission to communicate (such as other people's personal data, including that relating to Member Physicians or patients);
  • Not to publish anything that contains viruses, worms or any other dangerous code;
  • Not to publish medical opinions without having skills in this area;
  • To anonymize the photographs relating to the patients concerned by the shared clinical cases;
  • If necessary, obtain the authorization of the patient and / or his / her representative to publish the photograph anonymized or not on Dailymed;
  • To do their own business of any claims or disputes at the initiative of a patient, his representative or any person, or entity that would oppose the publication posted by on Daily
  • The contents they share are lawful, do not infringe public order, morality or the rights of third parties, do not infringe any legislative or regulatory provisions and deontological;
Report unwanted content:
If a member physician identifies unwanted content he has the opportunity to report it. If a case is reported, it is sent for review to Dailymed Support and if this clinical case does not comply with Dailymed's policy, the case is deleted.
Restrictions:
Dailymed reserves the right to limit the use of its Services, including the number of publications and the ability to contact other members.
Dailymed reserves the right to restrict, suspend or terminate the account of Member Physicians who do not comply with the TOS, the law, the code of conduct or whose use of the Dailymed Services is abusive.
Notifications and messages:
Member Physicians agree to receive notifications and messages via the application and contact details provided during registration or updated later.
Member Physicians agree to receive notifications and messages by the following means:
  • in the Dailymed application or,
  • the details provided (for example, e-mail address, mobile number, postal address).

Doctors agree to keep their contact information up to date. They can modify in their settings the frequency of notifications received via the Dailymed application.
Effective date and duration of Dailymed Terms of Use:
These terms and conditions of use take effect from the date of creation of the Profile by the user. These conditions apply throughout the duration of online services Dailymed and the use by the user.
Termination of the Dailymed contract:
Disabling the Dailymed account by the user suspends the application of the TOS. Deletion of User's Dailymed Account Terminates Agreement Between Dailymed and User on the CGU.
Exclusion of Dailymed's Liability:
About the operation of the application
Dailymed does not guarantee that the services will operate without interruption and without errors. Dailymed provides the service "as is" and "as available".
Regarding content shared by users
Dailymed declines all responsibility for inaccurate, partial, deferred, misleading, illegal, offensive or otherwise harmful information and content.
Dailymed does not re-read the content published by its Member Physicians or other persons. Member Physicians acknowledge that Dailymed is not responsible for the content and information shared about the application by users of the application.
Intellectual property:
The application, Dailymed, sites and all of the original content contained in the application as well as texts, logos, icons, graphics, graphic symbols, graphic interfaces, presentations, printable documents) are protected by the Code of intellectual property and any applicable international standards, and are, unless otherwise stated, the exclusive property of Agilous.
Any reproduction, representation, publication, transmission, use or modification, in whole or in part, of the Dailymed application and / or of any of its elements, made without the prior written authorization of Agilous, constitutes an infringement likely to lead to civil and / or criminal prosecution.
Applicable law:
These general conditions of use are subject to French law.
